DAE WEEK 2027 — BOOKING AND CHARTER TERMS Atlas Sailing · 4–11 September 2027 · Alimos Marina, Athens. 1. Your booking and the applicable documents The applicable charter partner conditions and completed charter agreement take precedence over earlier Atlas information about the charter, subject to the DAE arrangements in sections 3 and 8 below. Those arrangements govern customer collection and pre-departure cancellation where the source documents contain different wording. Mandatory consumer rights, privacy rights and Atlas's own legal obligations remain applicable. The completed agreement identifies the charter partner, the actual contracting parties and the party responsible for each service, and must record these DAE arrangements. Atlas's public description “charter partner” does not change the identity of a party in an original document. 2. Choosing and requesting your yacht Agree who is coming before requesting a whole yacht. Choose your yacht, group size and available extras, then sign in or create and verify an Atlas account. Before submitting a binding booking request, the lead booker reviews the yacht, dates, guest capacity, cabin layout, professional crew, selected extras, full price, payment schedule and applicable terms. Cabin information describes the sleeping spaces; it is not a tool for allocating individual cabins. No payment is due when you submit the request. Browsing the fleet creates no reservation. A waiting-list request or enquiry for a similar yacht is a non-binding sourcing enquiry and creates no hold. Availability requires separate confirmation by both Atlas and the charter partner. The booking-specific agreement must be completed for the actual yacht, travel dates and party, with all required signatures. Downloading a blank contract or accepting the website terms does not mean that the charter agreement has been signed by all parties. A different yacht, price, conditions or group arrangement requires fresh acceptance; your original request does not authorise an unknown alternative. 3. Your price and payments to Atlas Your accepted booking shows one package total for the yacht, included skipper, any selected additional professional crew, charter pack, deposit insurance and all other included or selected extras. Each professional crew service has one combined price. Those included items are not billed to you again as separate embarkation extras. The customer payment schedule applies to the whole package: • 40% is due to Atlas after both Atlas and the charter partner have officially confirmed the booking and the completed charter agreement has been signed by all required parties. • The remaining 60% is due to Atlas twelve weeks before departure: 12 June 2027 for this DAE Week. • If the booking is confirmed on or after the balance deadline, the whole package is due after both official confirmations and signature of the completed agreement by all required parties. Your confirmed booking states the exact amounts, deadlines and payment instructions. For this DAE Week, Atlas collects the entire agreed package, and professional crew, charter pack and deposit insurance already included and collected through Atlas will not be charged to guests again at embarkation. This arrangement takes precedence over different customer payment schedules or embarkation-collection wording in the source appendices. Atlas settles with the charter partner according to the applicable confirmed supplier invoice or pro forma; that supplier settlement does not change your customer payment schedule. The separately refundable security is not part of the package instalments. 4. Insurance, security and costs outside the package For this skippered DAE booking, the package includes the EUR 300 deposit-insurance premium. The EUR 500 refundable security is handled separately by the charter partner and recorded in the completed agreement. It is subject to the applicable security conditions, including possible deductions for damage or other covered charges; “refundable” does not mean an unconditional repayment. Deposit insurance and refundable security are different amounts. Flights and other travel to Greece, transfers, travellers' own meals and drinks, consumed fuel and water, and additional port or marina charges are outside the package unless your accepted booking expressly includes an item. The supplied yacht rates include the first and last overnight stays in the home port. Your booking states which extras are included. This is not a promise that every cost of the trip is included. 5. Cabins and professional crew The skipper always has a private cabin. Every additional professional also requires a separate private cabin. A crew cabin containing bunk berths remains one private cabin; it is not two separate cabins for two professionals. The yacht's licensed total-person limit and the number of remaining guest beds are separate limits, and both must be respected. Selecting additional professional crew can reduce guest capacity. Your group sleeps in cabins in the standard booking. Saloon sleeping is not automatically offered as additional guest capacity. A request for an alternative arrangement requires a separate check of the actual layout and permitted capacity, an updated offer where applicable, and acceptance before it becomes part of the booking. 6. Your trip portal and party details The lead booker receives the accepted terms and saved selection with the request confirmation. My Trips keeps the accepted yacht and booking details, cabin information, payments and relevant documents available for the trip. Once the booking is confirmed, customers cannot directly change the booked extras or booking particulars. Contact Atlas about a requested change; a change is not accepted merely because it has been requested. You can manage the agreed travelling party and provide the contact and traveller information needed for the booking and charter documents. Provide accurate names, email addresses and telephone numbers, and the address and identity-document details required by the charter agreement or crew list. Complete the relevant fields when requested in your trip portal. A picture of your passport or ID card is not a standard requirement for submitting a booking request. If a supplier or authority requires additional information, Atlas identifies what is needed and why. The privacy notice explains how personal information is handled. Trip guidance, packing suggestions and links for flights or grocery delivery are provided for convenience. You arrange those external services yourself unless your accepted booking expressly says otherwise. Their availability, prices and conditions are those of the external provider. 7. Arrival and return Arrive at Alimos Marina by 16:00 on Saturday 4 September 2027. The charter starts at 17:00. Return to base by 18:00 on Friday 10 September, and disembark by 09:00 on Saturday 11 September. All times are local. The completed agreement must identify the correct base, yacht, dates, licensed capacity and professional skipper arrangement. 8. Cancellation and the completed charter agreement For this DAE Week, the charter partner has confirmed that the cancellation policy on page 3 of its Terms and Conditions 2026 governs pre-departure cancellation. It takes precedence over the conflicting provision in clause 11 of the blank charter agreement that would retain all advance payments. The completed agreement must reflect this confirmed precedence. Cancel by email to Atlas using the contact address in your booking. The charge depends on when cancellation is notified before the charter start date: • More than 90 days before the charter start: 15% of the charter price. • 31–90 days before the charter start: 50% of the charter price. • Within 30 days before the charter start: 100% of the charter price. These percentages apply to the yacht charter price, not automatically to the entire package. Separate cancellation charges apply to a cancelled hired professional crew member: • Between 2 and 4 weeks before departure: 25% of that professional crew member's fees. • Less than 2 weeks before departure: 50% of that professional crew member's fees. If the cancelled week is booked again, the yacht owner may refund the applicable charter cancellation amount, less EUR 300 in Octopus Yachting administration fees. Such a refund is at the owner's discretion under the supplier policy. The 40%/60% collection schedule is not a cancellation schedule and does not itself determine the cancellation charge. Mandatory legal rights remain applicable. This precedence resolves the conflicting pre-departure cancellation provisions; it does not replace unrelated provisions concerning early termination, non-delivery or loss of the yacht. The original 2026 conditions and blank agreement reproduced below are source documents; they are not a completed or signed agreement for your 2027 trip. SOURCE DOCUMENTS The following supplier texts are reproduced without alteration from the supplied documents. Their original payment schedules, generic yacht particulars and other source wording have not been silently rewritten. Sections 3 and 8 above state the DAE collection and cancellation arrangements that take precedence over the conflicting source wording. The actual agreement for your yacht and week must record those arrangements, be completed for the correct yacht and trip, and be signed by all required parties. SUPPLIER TERMS AND CONDITIONS 2026 TERMS AND CONDITIONS 2026 YACHT RATES INCLUDE Charter period of 7 nights, current VAT 12% (subject to change according to the Greek regulation. Charter price will adapt accordingly), dinghy with outboard engine, bed linen and bath towels for up to two-week charters, blankets, first and last overnight in the home port, full galley equipment, electronic equipment, full water tank, spare fuel for outboard engine, spare gas bottle, snorkeling gear, Greek Waters Pilot book, maps of the sailing regions. YACHT RATES DO NOT INCLUDE Berthing in ports and marinas (except first and last overnight in starting base), consumption of fuel and water, transfers, additional equipment and services, crew, provisioning. Any transfers from/to the airport, port or hotel can be arranged upon request to our charter department. Food provisioning can be made by list order, prior to the arrival at the marina by making a request to our charter department. Otherwise, our base stuff will guide through the grocery store options of the area. CHARTER PACK (payable upon embarkation) Mandatory amount payable upon embarkation in cash: Tanna 47, Saona 47: 330 Elba 45, Lagoon 450: €300, Lagoon 42, Oceanis 51.1: €270 Lagoon 400, Oceanis 46.1: €230 Lagoon 380, Sun Odyssey 440: €220 Bavaria C42, Oceanis 40.1: €190 SECURITY DEPOSIT The security deposit is a mandatory fee required from the charterer upon arrival at the marina on the commencement date of the charter. Payment methods accepted include Visa, MasterCard, or cash; American Express is not accepted. This deposit is preauthorized and serves as a financial guarantee against potential damages or losses incurred during the charter period, in accordance with international maritime law and the policies of the insurance provider. In the event of damage or loss to the vessel, the charterer will be liable for the associated costs. The security deposit will be used to cover these expenses, and the charterer is required to replenish the deposit to its original amount to continue the charter. Failure to do so may result in the cancellation of the charter or legal proceedings to recover damages, including compensation for additional costs incurred by the operator. Upon termination of the charter, the security deposit will be refunded in full provided that no damages, losses, or violations of the charter agreement have occurred. If damages or losses are identified, and the costs exceed the security deposit, the difference will be billed to the charterer. Any remaining balance of the deposit, after deducting the costs, will be refunded to the charterer’s account if paid via credit card, or paid on-site upon vessel redelivery if paid in cash. SECURITY DEPOSIT INSURANCE The security deposit insurance serves to reduce the overall security deposit amount required at embarkation. It is payable in cash and comprises two components: the insurance amount, which is non-refundable, and the security deposit, which is refundable upon the completion of the charter, provided no damages or additional charges are incurred. The reduced security deposit, after applying the insurance, is payable via credit card. This process ensures a streamlined and secure transaction, facilitating a smoother embarkation experience for clients. Note: Security insurance is mandatory for all skippered charters. The standard fee includes a 300 € insurance premium and a 500 € security deposit, which together ensure comprehensive coverage and security during the charter period. Options close to charter start date are held for less than one week and only over email confirmation. Octopus Yachting is not obliged to accept a booking if the confirmation takes place after option expiration date and time • Bookings are valid and confirmed only when the Octopus Yachting charter contract is signed by all parties and all payments have been received within the pro-forma invoice stated times. Otherwise, Octopus Yachting has the right to consider the booked yacht as available and cancel the reservation. YACHT DELIVERY is the charterer’s confirmation that he/she takes full responsibility of the boat and its equipment as shown during check-in and also agrees that accepts the Terms & Conditions of the charter party. If the charterer encounters boat or equipment malfunctions/damages, these should be reported to the base manager or office of Octopus Yachting within 24 hours of the event, otherwise the base staff will act in accordance to the inventory list used during the check-in procedure. PAYMENTS OF THE YACHT RATE are made via bank transfer or credit card charge. All fees must be received by Octopus cleared of any payment, credit card or bank commissions. • Advance payment of 30% of the total charter fee is made upon confirmation • A second payment 20% of the charter fee is required 3 months after the reservation • Balance payment of the rest 50% of the total charter fee is due 35 days prior to the charter start date T: +30 2155150995 E: info@octopusyachting.com A: 21 METAMORFOSEOS Str, Alimos, 17455, Athens W: oc topu syach tin g.c om CANCELATION POLICY (applies to all bookings cancelled by email notice) • Within 30 days before the charter start date, the whole amount (100%) is retained • Within 31-90 days before the charter start date, half of the charter fee (50%) is retained • Within more than 90 days before, 15% of the charter fee is retained *in case the canceled week gets reserved again, it is the owner’s right to refund any of the above amounts minus 300€ for Octopus Yachting’s administration fees • 25% charge of professional crew fees is applicable if any hired crew member is cancelled between 2 and 4 weeks before the departure • 50% charge of professional crew fees is applicable if any hired crew member is cancelled in less than 2 weeks before the departure SAILING QUALIFICATIONS REQUIRED An international sailing certificate by at least one member of the crew, in English. A second member of the crew is recommended to have adequate sailing experience. RYA, ASA, Nautic Ed certifications are officially recognized but it is important that the charterers do not own a license with restrictions or limitations such as ‘Daylight hours’, ‘Day skipper’, ‘Inland waters’, etc. Further sailing courses might be required in order to obtain an adequate sailing license, but most times, an application to the sailing association that issued the certificate, is what it takes to issue a document which certifies the needed qualifications. The sailing licenses are inspected and approved by the port authorities, according to the Greek regulations. Charterers should ensure to have the appropriate certifications before they arrive as they are the only responsible in case of any rejection of their certification -and therefore the approval to leave the port- by the authorities. EMBARKATION TIME The charter period commences at 17:00 hours on the designated start date. The yacht will be delivered in a thoroughly cleaned and disinfected condition, equipped with fresh linens, and fully fueled with water and fuel supplies. DISEMBARKATION TIME The charter concludes by 09:00 hours on the specified end date. The yacht must be returned in the same condition as received, with full tanks of fuel and water, ensuring cleanliness and proper maintenance. RETURN TO DISEMBARKATION PORT It is mandatory to return the yacht to the designated disembarkation port the evening prior to disembarkation, no later than 18:00 hours, to facilitate check-in and check-out procedures and ensure proper handling of the vessel. Starting & Ending TimeTerms of Payment | 1. The Owner agrees to let on bare-boat charter and the Charterer agrees to charter the unattended above mentioned yacht (hereinafter called "the Yacht") for the period as stated above and commencing at 17:00 pm o'clock on the stated starting day and ending at 09:00 o'clock on the stated ending day (boat must return to base one day prior to the stated ending day at 18:00 the latest) for the sum as stated of which 40% is due and payable upon signing of this agreement, balance payment is due and payable 30 days before embarkation. Validity | 2. The signature of this Agreement by the Owner and/or his Agents becomes valid and binds the Owner to his obligations hereinafter mentioned only on condition that the Owner will actually receive the sums of the payments as indicated in Clause 1 above, in time. Delivery | 3. The Owner agrees:To fit out the Yacht and to hand her to the Charterer, without crew, afloat, clean, ready for sea, with all the gear and equipment indicated in the Yacht's brochure and its inventory list and in proper running and seaworthy condition at Preveza Insurance | b. To insure the Yacht and her equipment against fire, marine and collision risks and third party damage and against any and all loss or damage in excess of €………and the Charterer shall therefore be relieved of any and all liability which is covered by the said Policy, provided that such loss or damage is not caused or contributed to by any act of gross negligence or willful default on his part. Should the Owner fail or elect not to effect such insurance he shall assume the same responsibilities as if the Yacht were so insured, but he shall not be under any liability for the loss or damage to the personal property of or for any injury to the Charterer or any person on board with his permission. Delayed Delivery | c. To employ every reasonable effort to ensure delivery of the Yacht on the date and at the place mentioned in Clauses 1 and 3(a) hereof, but if for any cause whatsoever the Yacht shall not be available, the Charterer shall have the right of choice of one of following possibilities: | I. Provided that the following charter commitment of the Yacht allows it and that the Owner agrees, to prolong the period of charter by the same length of time by which the delivery has been delayed. | II. To leave the date of termination unchanged as in Clause 1 hereof and to be refunded by the Owner with an amount proportional to the time by which delivery was delayed at the rate corresponding to the total charter fees in Clause 1 hereof. Excess Delay | III. If the delay of delivery exceeds one fourth (1/4) of the total charter time, to cancel this Agreement and be refunded by the Owner with the total amount paid for this charter. In any of the events mentioned in this Clause, neither party shall be liable to pay to the other any other compensation for any loss or damage resulting from the curtailment or the cancellation of this Agreement. Redelivery (Return) of the Yacht and Delays | 4. The Charterer agrees:a. To redeliver the Yacht to the Owner at Preveza Port )cleaned-up, together with all her equipment, in the same good condition as she was at take-over, at the time designated in Clause 1, but, unless the Yacht has become a total loss, if he shall for any reason fail to deliver the Yacht at the aforesaid date and time, to pay to the Owner demurrage at the rate of the charter price per day of this Agreement increased by fifty percent (50%), for every day or fractional part of a day there-after until delivery has been effected. If he leaves the Yacht at any place other than the place designated in this Clause, to pay to the Owner all expenses involved in transferring the Yacht to the place of redelivery and pro-rata demurrage as above for the number of days required for this transfer, as well as for any loss or damage not covered by the insurance policy, which may occur on or to the Yacht until she has been taken over again by the Owner. Deposit and Guaranty Restrictions in the use of the Yacht Composition of Charterer's Party and Cruise Limits | b. To leave on deposit and as guaranty with the Owner on taking over the Yacht the amount of ……. euro to meet in whole or in part any claim by the Owner in respect of any loss or damage to the Yacht and / or her equipment not recoverable under the policy of insurance as in Clause 3(b) hereof and for any claim by the Owner in respect of the provisions of Clause 4(a) above. The aforesaid deposit shall be refunded to the Charterer, subject to the provisions above, after inspection of the Yacht, her gear and her inventory by the Owner. c. Not to use the Yacht for racing or for towing other craft, except in an emergency, or generally for any purpose other than that of private pleasure of the Charterer and his party which should include not less than ONE (1) qualified skipper and ONE (1) experienced crew members, but not more than 10 (ten)in all at sea, or to accommodate aboard any person other than those shown on the crew/passenger manifest nor to take the Yacht or permit her to be taken outside the area of the Greek seas nor to sublet the Yacht without the written consent of the owner. Observance of Customs and Diving Laws | d. Not to allow any person on board to commit any act contrary to the custom laws of Greece or of any country or contrary to the laws pertaining to fishing or under water fishing nor to seek and/or take possession of objects of archaeological nature or value and that in case any such act is committed this Agreement shall thereupon terminate, but without prejudice to any rights of the Owner and that the Charterer shall carry alone any resulting responsibilities and he shall answer alone to the appropriate Authorities. Agreement for Towing the Yacht | e. To take every possible preventive measure and precaution to avoid to bring the Yacht in any condition in which the Yacht will need to be towed to any point by another vessel, but should such a necessity arise, in-spite of the Charterer's efforts, to negotiate and agree with the captain of the other vessel on the price to be paid, before allowing the Yacht to be towed. Restrictions in Leaving Port | f. Not to leave a port or anchorage if the wind force is or is predicted to be over six (6) of the Beaufort Scale or if the harbor Authorities have imposed a prohibition of sailing or while the Yacht has unprepared damage or any of her vital parts such as engine, sails, rig, bilge pump, anchoring gear, navigation lights, compass, safety equipment, etc. are not in good working condition or without sufficient reserves of fuel or in general, when weather conditions or the state of the Yacht or its crew or a combination of them concerning the safety of the Yacht and her crew is doubtful. Restrictions in the Use of Canvas Restrictions in Navigation | g. When necessary, to promptly reduce canvas and not to allow the Yacht to be found sailing under an amount of canvas greater than the one insuring comfortable sailing without excessive strains and stresses on the rigging and the sails, not to sail the Yacht in any area not sufficiently covered by the charts at his disposal or without having previously studied the charts of the area and other printed aids on board thoroughly, not to sail the Yacht at night without all navigation lights functioning or without sufficient watch on deck. Yacht Log | h. To keep the Yacht's Log Book up to date, noting each day the port of call, the state of the Yacht and its equipment, any change in the composition of the crew when at sea, regularly, the times positions, weather conditions, sail plan and hours of engine operation. Itinerary | i. To plan and to carry out the Yacht's itinerary in such a manner as to reach the port of call farthest away from the point at which the Yacht must be returned to the Owner (Turn-Around Point) within the first one third (1/3) of the charter period and that two days prior to the termination of the charter the Yacht's port of call shall lie at a distance not greater than forty (40) N.M. from the point at which the Yacht is to be returned to the Owner. Reports of Yacht's Position and State | k. To report by telephone or cable to the Owner at reasonable intervals (every 3 days) the position and state of the Yacht and of her passengers, as well as in the event of any damage to the Yacht. Information | l. To study and acquire a working knowledge of any printed matter pertaining to the proper handling of the Yacht and to the conditions in the cruising area which may be made available to him by the Owner. Charterer's Sailing Qualifications | 5. This agreement is entered into on this basis of the Charterer's competence in sailing, seamanship and navigation stated by him in writing and in the event of any error, omission or mis-interpretation in this respect being subsequently discovered, the Owner shall be entitled to terminate this Agreement forthwith and to retain the Charter fees. Test of Sailing Competence of Charterer and his Crew | 6. The Owner (or his representatives) may require the Charterer and his crew to demonstrate their competence in handling and navigating the Yacht safely by actually operating the Yacht at sea with the Owner (or his representative) aboard and should the Charterer and/or his crew fail to satisfy the Owner in this respect, the Owner may terminate this Agreement as stated in Clause 5 above or place aboard the Yacht a seaman, if one acceptable by both the Owner and the Charterer, is available, at the expense of the Charterer, for as many days as the Owner will consider necessary for the safety of the Yacht and her passengers and any time required for this test of the Charterer's competence and seamanship will be part of the agreed Charter period. Take-Over of the Yacht & Time required for it | 7. The delivery of the Yacht to the Charterer will be made at the commencement of the charter period as designated in Clause 1. The time required to demonstrate the Yacht to the Charterer and to familiarize him with her shall be part of the agreed charter time. The free use of the Yacht will be granted to the Charterer after he has signed the Take-Over form. Acceptance of the Yacht Charterer's Responsibility during Charter Time | 8. Before signing the aforesaid form, the Charterer shall have the right to inspect the Yacht, her gear and her inventory thoroughly to ascertain that all are available and in good working condition, except as may be noted thereon, but the signature of the Take-Over form by the Charterer shall be deemed to imply acceptance of the Yacht which thereafter will be in the Charterer's full responsibility and the Charterer shall have no right to claim for any loss of time or expense occasioned by any accident or breakdown or failure of any part of the Yacht. Running Expenses Repairs of Damages | 9. After take-over, expenditures for port-dues, water, fuels, oils and any other stores required, as well as the repair of any damage or failure that may occur while the Yacht is in the Charterer's responsibility and which are not the result of normal and natural wear shall be made by the Charterer at his expense, provided that he previously obtained the consent of the Owner for the technical suitability of the repair to be made. In the case of repairs of damages or failures resulting clearly from normal and natural wear, the Charterer shall previously obtain the Owner's consent with regard to the cost and technical suitability of these repairs and the Charterer shall collect the pertinent receipts against which he shall be refunded by the Owner at the end of the charter. Ascertainment of Damages | 10. If any accident or damage is caused by the Yacht, the Charterer shall request from the nearest Port Authority to ascertain the damage or accident and the circumstances in which it has been caused and to make a written record and statement about it and he shall notify the Owner at the same time. Cancellation or Premature Termination | 11. In the event of cancellation of the charter by the Charterer, for any reason, except as mentioned in Clause 3 (c) (III), after signing this Agreement, all advance payments made up to the date of cancellation will be retained by the Owner, and the Owner reserves the right to refund the said deposits only if he succeeds in letting the Yacht to another Charterer for the same period and under the same conditions. In the event that the Charterer should elect to terminate the charter and deliver the Yacht prior to the date designated in this Agreement, the Owner shall not be liable to the return of any proportional part of the hire money. Total loss of Yacht | 12. Should the Yacht become an actual or constructive total loss before or during the charter period, this Agreement shall be deemed to be at an end and the Charterer shall recover from the Owner all charter money paid in advance to the Owner only in case the loss has occurred before the charter period, or during the charter period, provided that the Charterer or his crew were not responsible for the loss. Special Provisions | 13. The special provisions if any, set out in the Schedule hereto are fully accepted and form part of this Agreement. Agents | 14. The Agents of the Owners,act in good faith on behalf of both Owner and Charterer but contract as Agents only and in no way incur any liability for any acts, matters or things done, committed, omitted or suffered by either party, except for the responsibilities provided by the pertinent legislation of Greece. Arbitration of Disputes | 15. In the event of any dispute arising between the parties hereto with respect to this Agreement or anything herein contained the same shall be referred to two Arbitrators in Greece one to be appointed by each party, whose decision shall be final or to an Umpire to be appointed by such Arbitrators, if and when they shall disagree, the decision in such event of the Umpire to be final. | Additional Conditions (if any) | | |
